Disclaimer & Regulatory Compliance

Important legal information about our aggregator role, statutory transporter obligations and goods carriage compliance under Indian law.

Last updated: June 2026

1. Aggregator role

BookTruck.online Logistics operates as a technology aggregator and freight broker. We connect shippers with independent licensed road transport operators (“transporters”) who are themselves the “common carrier” under section 2(a) of the Carriage by Road Act 2007. We do not operate vehicles, employ drivers, or hold goods in our custody.

2. Carriage by Road Act 2007 — key provisions

  • Section 3: Transporters must be registered with the appropriate state authority.
  • Section 9: A goods forwarding note (GFN) is issued by the consignor; a goods receipt / consignment note (GR) is issued by the transporter.
  • Section 10 & Rule 6 of Carriage by Road Rules 2011: Maximum statutory liability of the transporter is limited to ₹10 per kg of the consigned goods, unless higher value is declared in writing and additional risk cover is purchased.
  • Section 12: Claims must be notified within 180 days of the date the goods should have been delivered.
  • Section 16: Transporters are not liable for losses arising from acts of God, war, riot, defective packing, inherent vice, or shipper's negligence.

3. Motor Vehicles Act 1988

All vehicles arranged through the platform carry valid Registration Certificate (RC), permit (national/state as applicable), fitness certificate, insurance and pollution certificate, in compliance with the Motor Vehicles Act 1988 and Central Motor Vehicles Rules 1989. The consignor is responsible for ensuring goods loaded do not exceed the permitted GVW.

4. GST & e-way bill

Under the CGST/SGST/IGST Acts 2017 and Rule 138, an e-way bill is mandatory for inter-state movement of goods valued above ₹50,000 (and intra-state as per state thresholds). The consignor is statutorily responsible for generating the e-way bill; the transporter must ensure the e-way bill is carried during transit.

5. Hazardous & restricted cargo

Hazardous goods (Class 1–9 per the Hazardous Wastes Rules and CMVR Chapter VIII) require licensed Hazmat-trained drivers, valid Hazchem permits and Emergency Response Information cards. The shipper must declare hazardous nature in advance. BookTruck.online will not arrange transport for prohibited goods (narcotics, illegal wildlife products, explosives without licence).

6. Pricing & estimates

All quotes returned by the platform are indicative. Final freight is confirmed in writing before vehicle placement. Quotes do not include statutory levies, tolls, detention, multi-point loading/unloading, escort charges, or insurance premium unless explicitly stated.

7. Limitation of platform liability

BookTruck.online's aggregator liability is limited to amounts directly received as platform / brokerage fees. Liability for goods loss, damage or delay rests with the assigned transporter under the Carriage by Road Act framework above.

8. Jurisdiction

These terms are governed by Indian law and subject to the exclusive jurisdiction of the courts at Tada, Andhra Pradesh, India.
